The New—Cardless!—National ID

Your chance to comment on a Department of Homeland Security plan to tap into state drivers’ license databases and create a new national ID system expires next week. It’s the groundwork for a cardless national ID, which threatens liberty even more than card-based schemes like REAL ID.

The E-Verify program’s move to merge federal background checks and state driver license data sets the stage for satisfying all three elements of a national ID. (Two years ago, I discussed what constitutes a national ID in some detail.) E-Verify has not satisfied these criteria up to now, but the pieces are coming together quickly.

First, it is national. That is, it is intended to be used throughout the country, and to be nationally uniform in its key elements. If its proponents have their way, E-Verify will indeed soon go national, a requirement on every employer to vet new workers past the federal government’s databases.

Second, its use is either practically or legally required. This is a judgment call, but in two diferent ways, E-Verify appears to meet this element. First, not having data in the E-Verify databases means not having legal work, so “participation” in E-Verify can be fairly called practically required. Second, try to opt out of the system and you will meet a dead end. The program includes no opportunity I know of to refuse participation. It’s legally required if the state or federal governments have got your identity data.

I could be wrong, of course. Interested researchers should try contacting their state motor vehicle bureaus (cc: your state legislators) and ask not to have data about you transferred to the federal government for E-Verify. Please let me know what you learn.

The final “element” of a national ID is that it is used for identification. Up to now, E-Verify has  largely worked by comparing identifiers. (I.e., Does this name match this Social Security number?) The current plan is to tap into state databases for more identifiers: name, date of birth, driver’s license/permit number, and so on. From there, it’s a short ride to gathering drivers’ license photos and biometric descriptors. (E-Verify already uses federally acquired photos in its “Photo Screening Tool.&#8221 With the inclusion of your driver’s license photo, the E-Verify system will be able to display your picture on the screen of anyone who looks you up, allowing for positive identification.

This is a national identification system. If every employer has to use E-Verify—or even every major employer—it will become the all-purpose security device, used for cashing checks, confirming the name on credit cards, and looking you up at the prescription counter. Of course, it will be used at airport checkpoints. You’ll be screened through E-Verify at entrances to government buildings—maybe private buildings, too. And why not for random, “instant” checks at the subway or bus station? 

Just remember: If you have a tax dispute with the government, the Department of Homeland Security might flag you in the database—or it might de-identify you entirely—until you get right with the government.

Because it’s a database system, you won’t be able to argue your case like you can in the familiar card environment. With a card, at least, you can say, “No, look. This is me. This is my ID card. This is my picture. Give me my prescription.” With E-Verify, the answer will be, “Sorry, you have to talk to DHS or Social Security.” For good reason, I named my paper on electronic employment eligibility verification, “Franz Kafka’s Solution to Illegal Immigration.”

Arguments for the E-Verify system sounding in practicality and common sense do not hold up, but there are also principled reasons to oppose having a government background check system. Using E-Verify, the Department of Homeland Security is rapidly assembling a national ID system that can be converted to boundless uses. In addition to controlling employment, E-Verify can be put to use in regulating access to health care and housing, in gun control and registration, in monitoring travel and lodging—the list goes on and on.

I went through the arguments against having a national identification system in my book, Identity Crisis. In brief, a national ID would strip us of privacy even faster than is already happening, producing formal dossiers and increased surveillance. A national ID would transfer power en masse from individuals to governments. They would administer our rights by controlling the tools we need to navigate a “papers, please” society. A national ID would also be insecure, as it centralizes and homogenizes information assets (identity data) that are more secure if widely dispersed and heterogeneous.

As I noted last week, the federal government cannot and will not implement the REAL ID Act. So it’s on a new tack: E-Verify will soon be the new national ID.

On Wednesday, the U.S. House ignored the wishes of millions of American voters and passed a do-nothing “Continuing Resolution” (CR) to fund the government for the next three weeks.

The CR now heads to the Senate for an expected vote on Thursday. Gun Owners of America has written Senate members to let them know of its opposition to that CR.

The first issue is ObamaCare. Republicans ran for election promising that they would repeal it -– or at least defund it. But it is increasingly apparent that some members of the leadership lack the courage to defund ObamaCare on the short-term CR … or on the long-term CR on April 8 … or on the debt limit.

So when, exactly, do they intend to show us that their word is worth the paper it is written on?

The problem for gun owners is that ObamaCare will allow the Bureau of Alcohol, Tobacco, Firearms and Explosives(ATF) to troll its health database for Americans who suffer from ailments such as PTSD –-millions of whom could find themselves subject to a gun ban under 18 U.S.C. 922(g)(4).

The second issue for us is that the three-week CR fails to include the Boren-Rehberg amendment, which would block efforts by the ATF to set up an illegal gun registry of multiple firearms sales.

Without defunding ObamaCare –- and without incorporating the Boren-Rehberg amendment -– this CR will continue to fund these unconstitutional activities, thereby endorsing them.

We are particularly sickened by cowards who are so afraid that Barack Obama will shut down his own administration that they are willing to allow him to dictate every provision in each CR.

“Read the Bills Act” (RTBA)

You can read the text of RTBA by clicking the Background tab above, or you can start by reading a summary of the legislation below. Following that summary is a description of our strategy for passing RTBA, and then a call to action.
Part 1: What RTBA does and why

Most Congressmen are lawyers, and many others are businessmen. They know what “fiduciary responsibility” is. For Members of Congress, fiduciary responsibility means reading each word of every bill before they vote.

But Congress has not met this duty for a long time. Instead . . .

* They carelessly pass mammoth bills that none of them have read. Sometimes printed copies aren't even available when they vote!

* Often no one knows what these bills contain, or what they really do, or what they will really cost.

* Additions and deletions are made at the last minute, in secrecy.

* They combine unpopular proposals with popular measures that few in Congress want to oppose. (This practice is called “log-rolling.”)

* And votes are held with little debate or public notice.

* Oh, and once these bills are passed, and one of these unpopular proposals comes to light, they pretend to be shocked. “How did that get in there?” they say.

There's a basic principle at stake here. America was founded on the slogan, “No taxation without representation.” A similar slogan applies to this situation:

“No LEGISLATION without representation.”

We hold this truth to be self-evident, that those in Congress who vote on legislation they have not read, have not represented their constituents. They have misrepresented them.

And since Congress has repeatedly committed “legislation without representation,” strong measures to prohibit these Congressional misrepresentations are both justified and required.

To this end we have created the “Read the Bills Act (RTBA).” RTBA requires that . . .

* Each bill, and every amendment, must be read in its entirety before a quorum in both the House and Senate.

* Every member of the House and Senate who plans to vote in the affirmative – to vote for tax increases, for spending bills, for the retention or creation of programs, in support of laws and regulations – must sign a sworn affidavit, under penalty of perjury, that he or she has attentively either personally read, or heard read, the complete bill to be voted on.

* Every old law coming up for renewal under the sunset provisions must also be read according to the same rules that apply to new bills.

* Every bill to be voted on must be published on the Internet at least 7 days before a vote, and Congress must give public notice of the date when a vote will be held on that bill.

* Passage of a bill that does not abide by these provisions will render the measure null and void, and establish grounds for the law to be challenged in court.

* Congress cannot waive these requirements.

The effects of these provisions will be profound . . .

* Congress will have to slow down. This means the pace of government growth will also slow.

* Bills will shrink, be less complicated, and contain fewer subjects, so that Congress will be able to endure hearing them read.

* Fewer bad proposals will be passed due to “log-rolling.”

* No more secret clauses will be inserted into bills at the last moment.

* Government should shrink as old laws reach their sunset date, and have to be read for the first time before they can be renewed.

And all of these things will enable a larger DownsizeDC.org to more effectively lobby Congress for small government.
Part 2: Our Strategy for passing RTBA

Our plan for passing this legislation is simple, but powerful.

* We have submitted a copy of RTBA to every member of Congress.

* We are asking every member of the House and Senate to sponsor this legislation and work for its passage.

* We are mounting a campaign to recruit thousands, and perhaps millions of Americans to lobby Congress to support RTBA.

* We are promoting this campaign with a variety of tactics, from Internet networking, to media interviews, to whatever it takes.

* We will run targeted radio ads, letting citizens know that their Congressman is failing to support this badly needed reform.

The need for this reform is so self-evident that nearly every person in America should support it, and few oppose it. We see no reason why we should not be able to overwhelm Congress with calls to pass this legislation.

* We dare Congress not to pass it. The more they resist, the larger and stronger we will grow.

* We dare anyone to challenge it in Court. The more the lobbyists attempt to defeat this reform, the larger and stronger we will grow.

* We dare the Courts to declare it un-Constitutional. If they do, we will grow larger and stronger as a result — probably big enough to begin a campaign to amend the Constitution to forbid “LEGISLATION without representation.”

There is simply no reason that any normal, tax-paying American should oppose RTBA. And the more the “powers that be” resist these reforms, the larger and stronger we will grow.

We win either way. And thus, we believe, we will win in the end.

While the media tries to cover its tracks in presenting the Arizona shooter as a right wing tea party conservative, the real details are coming out and it isn't a pretty picture.

He obviously has some mental issues and his day in court will not come soon enough for the victims and their families in AZ.

Our thoughts and prayers are with Congresswoman Giffords who is still in critical condition and with the family of Federal Judge John Roll, Nine Year Old Christina Green, and the families of the other victims.

I have been to many political events and have seen people getting vicious and hateful even threatening but it was never the conservatives instigating it.

Events like this one may cause conservatives to shy away in fear that if they speak up, they will be looked at as a target or they may be looked at as a suspect if their view is in opposition of the elected representative who is speaking.

We must always remain vigilant while attending these types of events to make certain their are no left wing extremists inciting violence or anyone else for that matter.

Yes our nation has gone in a direction that the majority of Americans do not like, but the answer to the problems in is the voting booth and through the use of civil dialogue.

The 2010 mid term elections proved that we can get the "change" we want without even raising our voices.

That's because REAL ID - which is a de facto national ID card - lays the foundation for a future police state.

There's a silver lining in the monstrous, 1,926-page appropriations bill (H.R. 3082). This bill rescinds funding for a REAL ID "hub." The House already passed the bill, and the Senate will consider it as soon as TODAY.

This hub would have created a centralized ID verification system, where states share driver information with each other. Without this hub, REAL ID suffers a fatal blow.

That's why we're asking you to tell Congress to support this cut in REAL ID's budget, and to repeal REAL ID altogether.

I'm glad that the House is rescinding funding for a REAL ID hub in the H.R. 3082 budget bill. My Senators should ensure that this rescission remains in the bill.

But you should do more. Repeal REAL ID entirely.

* REAL ID assumes I am a foreign terrorist or illegal immigrant, and that I must "prove" my innocence
* I am punished with higher fees, more red tape, and longer DMV lines
* And my private information will be centralized, making me more susceptible to identity theft and other dangers

* The REAL ID law still exists as an unconstitutional, unfunded mandate on the cash-strapped states

All of these things started moving forward immediately after 9/11 under the command of Republican George Walker Bush and has continued under Democrat Barack Hussein Obama.

Some of these things took place out of the supposed necessity of security over safety and others for the supposed betterment of the people.

Now nearly a decade after most of this has taken place, the people have said enough. The elections showed that the people do not like Obama's definition of change.

There are groups planning on refusing TSA orders to go through the backscatter x ray machines and refuse to allow them to touch their junk.

They understand that the TSA is threatening to send them to jail or assess an $11,000.00 fine, but they plan on standing up for their rights come Wednesday November 23rd once of the busiest times of the year for airports.

The TSA response was that if you don't want you or your children to go through x-rays or be groped by one of our fine employees (TSA WORKER ARRESTED FOR CHILD PORN), then you can find another way to get to grandmas house for Thanksgiving or any other holiday.

In the mean time, I choose not to fly, I can get where I need to go via other non invasive means or not go at all then to endure such humiliation and degradation. Where would the airlines be if people stopped showing up?

But while you are boycotting the TSA, be sure to tell your newly elected member of congress that you have had enough and that you want a common sense approach done for security. Their are much more effective ways to find potential terrorists than to groping old women in wheel chairs, men wearing loose clothes or children.

The news is coming out, the polls are in OBama sucks and will most likely loose any chance for re-election in 2012 along with the remaining sellout Democrats and Republicans who have out spent all previous administrations combined all the way back top President Washington.

But this news isn't anything knew to the people of America. Obama's lies er rhetoric as he likes to call it have not been forgotten by those who supported him and those who voted for him because they just couldnt stand the last bunch of RINO Republicans controlling the house and senate during the Bush years.

That being said, who cares about Obama at this point? We have to focus on helping those running against incumbents to rid ourselves of those who have defied the will of the people. I have never once in my working history been able to completely ignore the will of my employer and think that I would continue to work for them.

Well the same goes for all branches of the Legislative body. We must focus our attention on those candidates that will stand up to their oath of office and preserve, protect and defend the Constitution and our liberties.

Most Americans just want to live their lives and be left alone to raise their families as they so choose. They don't want to be told they must buy health care or partake in ObamaCare, they are tired of bailing out big banks and corporations like GM and they are sick of all the taxes and other regulations that prevent them from the pursuit of happiness.

Americans do not want to be spied upon by their own government under the guise of protection as though they are some type of criminal. Whatever happened to innocent until proven guilty?

They also do not want any form of national ID Card ie Real ID, Pass ID or the like. They want to be able to Live Free.

In order to do this Americans must unite in one voice and say "Enough Already!" and vote the collective bums out of office.

We are told over and again that Islam is a "religion of peace" yet the US State Department issued worldwide travel alert to Americans traveling "and cautions that 'the potential for further protests and demonstrations, which may turn violent, remains high.'"

I personally think the idea was a moronic and ungodly thing to even talk about doing. Regardless of the fact that it may have resulted in what Pastor Jones wanted and that was to prevent the mosque from being build on ground zero.

If he wanted to take a stand against a religious ideology he was adamantly opposed to, he should have used the book that he wanted to burn to educate people why he had issues with it.

Better yet, he should use the Holy Bible to show why he believed that following the teachings of Christ was the correct path to take.

However, I keep reading that Islam is a "religion of peace", yet so many are dieing for refusing to follow its ideologies and for decimating what it deems to be its holy words.

In the United States we have a fundamental right to worship any god we want or none at all. While I choose to serve the God of Abraham, Issac and Jacob, others can choose to serve whomever they want. After all, God will ultimately judge us all in the end.

If the Muslims want to build a mosque in NYC near ground zero, it is their right to do so, though most Americans and many Muslims agree that it is in bad taste.

Likewise, if some misguided pastor in Florida wants to burn Korans, than that is his first Amendment right to do so. But the very act of him doing such a thing is diametrically opposite of the message of Love that Gods word teaches.

San Diego, CA, August 25, 2010 -- The most recent total from the Privacy Rights Clearinghouse’s Chronology of Data Breaches shows more than a half billion sensitive records breached since 2005, leaving Americans vulnerable to identity theft.

Employees losing laptop computers, hackers downloading credit card numbers and sensitive personal data accidentally exposed online -- the Chronology of Data Breaches shows hundreds of ways that the personal information of consumers is lost, stolen or exposed.

The Chronology of Data Breaches, a project of the Privacy Rights Clearinghouse since 2005, lists incidents involving breached consumer information, such as personal medical records, credit card numbers and Social Security numbers.

The most recent total, published last night, is a wake-up call to consumers who think identity theft can’t happen to them.

The Privacy Rights Clearinghouse estimates that the Chronology shows only a fraction of the total number of data breaches.

"This is a conservative number," says Director Beth Givens, "We generally learn about breaches that garner media attention.
Unfortunately, many do not. And, because many states do not require companies to report data breaches to a central clearinghouse, data breaches occur that we never hear about.
Our Chronology is only a sampling."

Data breaches of sensitive information, especially Social Security and credit card numbers, make consumers vulnerable to identity theft. According to a 2009 Javelin Research & Strategy, individuals are four times more likely to be the victim of identity theft in the year after receiving a data breach notification letter.

The recently expanded Chronology provides consumers and researchers the ability to perform rapid searches to identify trends in data breaches. It also allows visitors to look up businesses, agencies and organizations by name.

Unfortunately, consumers cannot completely protect themselves from a data breach. It is up to organizations that collect data on consumers to take the steps to ensure the privacy
and security of the data they collect and maintain.
