The Senate will likely vote on the DISCLOSE Act again TODAY. That's why we're sending this message earlier than normal. It's urgent that you act quickly.

Incumbents banded together in 2002 to make it effectively a crime, punishable by jail, for a non-profit group like DownsizeDC.org to broadcast issue ads during the final days of an election campaign.

The Supreme Court fixed this problem earlier this year, getting something right for a change. In the Citizens United case they restored the right of non-profit corporations like DownsizeDC.org, Inc., to broadcast issue ads during elections.

The name of the case fits. Non-wealthy CITIZENS are UNITED in organizations: They band together using their First Amendment rights of association and press to publish and broadcast their opinions. Bad laws have forced we citizens into a legal cul de sac, where WE NEED CORPORATIONS LIKE CITIZENS UNITED AND DOWNSIZE DC TO HELP US ACHIEVE OUR GOAL OF BEING HEARD. But . . .

In this year when most Americans want to fire Congress, the incumbent politicians are making a last ditch effort to protect incumbency -- by chilling dissent. Here's what's at stake . . .

Because DownsizeDC.org is un-willing to expose its list of supporters (your name) to the Federal Election Commission we would be PROHIBITED from running ads exposing a candidate's record.

We explain, in greater detail, how this law would affect the groups you love most at the web page opposing the anti-First Amendment DISCLOSE Act.

To create artificial demand for this terrible bill, numerous politicians, including the President, have lied about the Citizens United decision. It's time to call them on it -- literally.

And I'm in on the secret.

If you vote for this bill then it means you want to disenfranchise the little guy for the benfit of yourself and big special interests.

There's a better alternative. As James Madison said Federalist No.10, the best way to counter the influence of tremendous wealth, and the concentrated benefits that big corporations seek, is to foster the freedom for many voices to join the political fray. That's why the First Amendment reads, "Congress shall make no law," that even "abridges" (remotely infringes) on my rights of association and expression -- NO LAW.

I emphatically urge you to work and vote for a filibuster, and failing that, to work as hard as you can to defeat the DISCLOSE Act.

I know many think it's a waste of time to call the Outlaw Congress, but we have had some major victories.

Our voices have defeated bills before and we can do it again if enough people get on the phone. Spread the word to family and friends. Some things can't be stopped by nullification.

1. The sickening "DREAM ACT" will be voted on tomorrow.

It will reward illegal aliens by giving a "pathway" towards citizenship. HOOEY.

It's "for the children" of illegals. HOOEY.

The Act covers off spring of illegals who have no right to be in this country, much less sucking our educational resources up to the age of 35!

The "reasoning" behind this in your face amnesty is absurd. Since kids of illegals are here illegally, they never had the right to attend our schools and colleges "to lead a better life." They should all have been deported long ago. Their parents are criminals for smuggling themselves into our country and children of illegals share the same status. While unfair, they can blame their parents.

It means instead of deporting illegals holding jobs that belong to Americans, that ACT will make sure millions of illegal aliens keep a job while Americans stand in unemployment lines and living off welfare and food stamps.

The military is desperate for more cannon fodder to fight these immoral and grotesque invasions in Afghanistan, Iraq and around the world. Part of the ACT requires a two year hitch.

70% of Latinos voted for the Red in the White House. The millions of illegals who will be given a free pass on this ACT --- think they will vote Republican?

I believe most Republicans will vote no, so it's the Democrats that must hear a huge roar from we the people.

2. Comrade Harry Reid is going for broke with a vote tomorrow on the "don't ask, don't tell" for sexual deviants in the military.

There is no constitutional right to serve in the military.

Staples pushed Trans Texas Corridor, no friend of property rights

(SAN ANTONIO, TX - September 20, 2010) Terri Hall, of Texans Uniting for Reform and Freedom (TURF), released the following statement in response to Agriculture Commissioner Todd Staples' September 16 press conference on eminent domain reform. Staples is seeking re-election amidst Texans' outrage over the Trans Texas Corridor and the eminent domain abuses it created.

BEGIN STATEMENT: "I find it offensive when politicians use the sacred right of Texans to protect their property from unjust government takings through eminent domain for their own personal and political gain. Enough with election year platitudes, actions speak louder than words. Let's look at Todd Staples' actions. He has FAILED to prevent gas tax theft and properly inspect gas pumps across the state (go here to see recent revelations about rampant gas tax theft due to stations falling through the cracks), and he's only encouraged eminent domain abuse by voting to create the Trans Texas Corridor when he was a legislator.

"So Staples' new-found zeal for protecting property rights is not exactly sincere. During his entire tenure in the legislature, he did not author or pass one single piece of legislation to protect property or landowners from eminent domain abuses. He voted for the legislation authorizing the Trans Texas Corridor and sponsored legislation preventing landowners from negotiating directly with the toll operators along the path of the Trans Texas Corridor to develop businesses along the corridor. However, he allowed the state to lease a private citizens' condemned land to private companies. This same bill, HB 2702, also severely limited the rights of property owners whose land was to be bisected by the corridor.

“In addition to all of this, Staples essentially served as the official spokesperson for a major effort by the political action committee of an insurance company to encourage Texans to pass a fundamentally flawed constitutional amendment, Prop 11, that did little to really protect Texans from eminent domain takings, but instead gave voters a false sense of security.

"For Todd Staples to stand up this week and say Texas needs stronger laws to protect citizens from eminent domain takings is comical. It is an admission to the voters of this state that he sold them a flawed constitutional amendment to further his own political career.

"His record on transportation isn't any better. Staples authored legislation to make EVERY Texas taxpayer subsidize loser toll projects that can't pay for themselves. ‘Staples’ bill removes an $800 million-a-year lid on tax subsidies of toll roads…’ [SOURCE: Austin American Statesman, May 12, 2005].

“Todd Staples has also taken thousands of dollars from Zachry Construction, its executives, and its PAC. Zachry is the San Antonio-based company that along with two Spanish-based companies, CINTRA and ACS, won the development rights to two TTC corridors, TTC-35 and TTC-69.”

There’s plenty of federal holidays for Americans to celebrate. On July 4th, there’s independence from King George’s England. On the first Monday in September, a holiday was dedicated to the “social and economic achievements of American workers.” Other days throughout the year celebrate autumn harvest, soldiers who died in the civil war and even a person who sailed to this continent nearly three centuries before the country was “founded.”

When there’s no federally-sanctioned holiday to call upon, protesters and activists across the political spectrum often pick “important” dates to schedule events to bring attention to their cause. We’ve seen protests on Tax Day, Independence Day, May Day, Earth Day, and more. And, in the past few weeks we saw great importance placed on days that doesn’t even have a letter in their name, 8/28 and 9/12.

But nowhere to be found on these great lists of “federal holidays” or “protest days” is a celebration of the document that defined the principles of liberty that this country was supposedly founded upon – the Constitution.

LIMITING POWER

The Constitution was signed on September 17, 1787, and every year that date passes by with hardly a sound. Sure, now that it’s considered a day of “federal observance” you’ll find government schools around the country including it in their lesson plans. But these discussions generally focus on “Constitution Trivia” instead of what’s really important. While it may be good to educate our young on how many years a Senator serves, or how Supreme Court justices are appointed, it’s not enough. Seriously lacking in the public discourse is the actual purpose of the Constitution – its underlying principles.

When the Constitution was being considered for ratification, there was strong opposition from famous American figures that included George Mason and Patrick Henry. One major reason for this was a fear of too much power. The founding generation spent their lives toiling under a tyranny – a government without limits. But, when the Constitution was written, it was done to codify in law that the powers of government would be limited to those which had been delegated to it – and nothing more.

The entire system was created under the principle of popular sovereignty – that ‘We the People of the Several States’ created the government, and all powers not delegated to it, were retained. But that’s not something you’re likely to hear from politicians in Washington DC, political pundits, schools, or just about anywhere else. It’s generally not in their interest, either.

If politicians and their backers were promoting such crazy ideas as “originalism” and “limited government” they’d never be able to convince you that they have the power to tell you what kind of health care plan you’ll be getting, how big your toilet can be, what kind of plants you’re allowed to grow, where you’re allowed to exercise your “right” to free speech, whom you can buy and sell from, and even when you must send your children to die for them.

MORE OF THE SAME

Throughout history, even kings and queens have often failed to survive such acts of hubris; but, in “free” America, the major parties that produce all the presidents continue to receive approval through tens of millions of votes. And where has that gotten people?

Well, let’s take a look at some major issues.

• If you were opposed to war in the Bush administration, you’ve still got the same wars and threats of wars under Obama.
• If you were opposed to national health care under Clinton, you got a massive expansion of government health care under George Bush, which laid the groundwork for an even bigger expansion under Obama.
• If you didn’t like the federal government passing the Patriot Act without even reading it, you’re still getting the same (or worse) failure to read legislation today.
• On the other hand, if you liked the Bush bailouts, you’ve gotta love the ones that Obama has given you!

No matter what side of the political aisle you sit on, the federal government is not your friend. It’s not a friend to the Constitution, and it’s certainly no friend to your liberty. For years and years…and years, people have yelled “vote the bums out!” “Call Congress now!” “March on DC!” But, in the long run, little to none of this actually works.

If you oppose this national health care plan, they’ll give you that one. If you oppose one war, you’ll get another one. If you oppose today’s bailout, they’ll find a different one tomorrow. Decade in and decade out, the government keeps growing, and your liberty keeps shrinking. And it doesn’t matter if the person in charge is named Obama, or Bush, or Reagan, or Clinton.

The bottom line? Looking to the federal government – whether it’s though elections, or protests, or lawsuits, or rallies – is a failed strategy. So how about trying something new?

A DIFFERENT PATH: NULLIFICATION

People around the country are recognizing that there is a different path, and one that has a chance of working on a big scale, too. Already nearly a dozen states have passed 10th amendment resolutions reaffirming the proper role of government under the Constitution. 25 states have stopped the real id act dead in its tracks in most of the country. 8 states have passed firearms freedom acts – to nullify some federal gun laws and regulations in their state. 5 states have already passed laws to nullify federal health care mandates – with more on the way. And, fourteen states now have medical marijuana laws in direct opposition to federal laws..

In Jeffersonian-speak, this all falls under the banner of “nullification.” When a state ‘nullifies’ a federal law, it is proclaiming that the law in question is void and inoperative, or ‘non-effective,’ within the boundaries of that state; or, in other words, not a law as far as that state is concerned.

While some in government and the media would like to paint this essential tool for resisting federal tyranny as solely aligned with the South in the War Between the States – and nothing more, they’re missing some essential history. It’s been used in efforts to advance free speech, help runaway slaves, resist high taxes and more.

And recently, the Bush-Era Real ID Act is now virtually dead in the water, not due to elections or rallies, or calls to Congress – but instead, due to state-level resistance. In the past three-plus years, approximately two dozen states simply refused to implement the law. The result? The law is still on the books in Congress. It’s never been overturned by a federal court. But yet – in most of the country – it’s virtually null and void.

Even better, this is no single-issue movement. Legislators in over 20 states are considering legislation to nullify some federal gun laws, and another 20 are looking at ways to nullify national health care. 15 states are weighing legislation or ballot initiatives that could turn them into medical marijuana states by next year, and activists in over a dozen states have been pushing for legislation that would require their governors to bring national guard troops home from Iraq and elsewhere. On top of it, a national tour has been launched in support of these efforts – something that may have been impossible just a few years ago

LIBERTY BEGINS WITH YOU

Issue by issue, law by law, the best way to change the federal government is by refusing to comply with it on a state and individual level. Withdrawing our consent for unconstitutional “laws,” acts, regulations….and mandates…has a much better effect than begging or demanding that DC limit its own power.

Over the years, wise men and women warned us that the Constitution would never enforce itself. I believe it’s time for people to recognize this as fact, and bring that enforcement closer to home.

Whether you’re on the left, or on the right, or even somewhere in the middle, the path to freedom, the path to your political goals lies not in Washington D.C. Instead, it lies in Madison, and Jefferson (City)…and other state capitols around the country.

So this Constitution Day take a new pledge. Ignore and nullify the federal government. When it refuses to follow the Constitution year in and year out, it becomes as worthless as it is dangerous.

A W-9 is the IRS's "Request for Taxpayer Identification Number and Certification." Because of the new healthcare law . . .

If you spend as little as $55 at the local Office Shack each month, you'll exceed $600 for the year. That means you'll need to file a 1099 with the IRS for Office Shack. Apparently, things are going so well in the Middle East that the State Department now feels it can turn its attention to banning the lawful possession of firearms by American citizens.

In a little-noticed decision in March, the Obama administration reversed an earlier decision and moved to block the importation of 857,470 lawful M1 semi-automatics which were being sold by South Korea in an effort to raise money for its military. According to Hillary Clinton's State Department, this action was taken because the M1's "could potentially be exploited... for illicit purposes."

Even worse, a spokesman for the State Department left the impression that the valuable historic relics could even be melted down, as Clinton's husband did during his administration. Suffice it to say that this is just another reiteration of the same anti-gun political theatre. And the cheers coming from anti-gunners like Dennis Henigan of the Brady Campaign are ample proof of that.

Possession of these guns by Americans is lawful. They are antiques of historical interest, particularly for those who, unlike Clinton and her husband, served this country honorably in America's foreign wars. And anyone wishing to acquire one would have to go through an Instant Check.

If any American, going into the November elections, had any doubt that Barack Obama and the Democratic Party leaders hate guns and have contempt for the Second Amendment, this is proof. Reps. John Boozman and Paul Broun are submitting a letter to State Department Secretary Hillary Clinton -- demanding that this unlawful decision be reversed.

And we are working with several legislators to offer an amendment on the next available legislative vehicle which would prohibit the administration from blocking the importation -- or even the destruction -- of these firearms. Please see the ACTION item and pre-written letter below.
